What does Motor Legal Care cover me for?

If you’re involved in a road traffic accident, and you’re not at fault, we’ll pay for the cost of a solicitor to represent you to recover your uninsured losses.

We can also help to provide you with a replacement vehicle if yours is off the road.

What are uninsured losses?

These are any losses you’ve suffered as a result of a road traffic accident, where you weren’t at fault, that aren’t otherwise covered by your motor insurance.

These are typically your policy excess, bodily injury, damaged possessions, or, if you’re only insured for third party or third party, fire and theft, it would also include the cost of repairs to your vehicle.

Are you covered if you're at fault?

Motor Legal Care offers a range of benefits. Whilst we can only help with pursuing your uninsured losses if you’re not at fault, we may be able to offer you advice or assistance following your accident. Does this cover help me if I had an accident and someone wants to claim against me and my insurance?

If another party is looking to make a claim against you, you’ll need to notify your motor insurance company who will deal with the claim. However, we may be able to help if you need legal advice.

Will I still need to buy Legal Expenses insurance through my motor insurer?

You may find your insurer offers you different levels of cover so you should check this before making a decision on whether to buy any other policy.

The limit of cover is £50,000 for uninsured loss recovery – what if my losses are more than this?

£50,000 is the maximum amount we’ll pay for legal costs e.g. paying for a solicitor to represent you to recover your losses – it does not relate to the amount of compensation you’ll receive.

When does my cover come into effect?

Motor Legal Care will automatically be included in your membership from 1st April 2013, regardless of when your membership is due to renew.

What if I don’t want it?

As Motor Legal Care now comes as standard with your Rescue membership we’re unable to remove this cover. However, it’s included free of charge and there is no obligation to use the service – we just want to make sure we’re doing everything we can to make motoring easier and safer for our members.

Who is covered under the Motor Legal Care policy?

If you’ve got personal based membership the policy will cover any member named on the membership. If you have vehicle based membership it will cover any driver of the vehicle covered by the membership.

In addition, for claims for uninsured loss recovery following a road traffic accident, the policy will also cover any passengers in the vehicle.

Why is the cover now free?

We want to help make motoring as easy and as safe as possible for our members. Being involved in a road traffic accident can be a traumatic experience, and knowing how to deal with the legal repercussions can be confusing. We want our members to feel reassured, knowing that they can count on the RAC no matter what.

Accident Care

If I'm involved in an Accident, can I call on the RAC to recover me?

Make the RAC your first call if you’re involved in a road traffic accident, and we’ll rescue and recover your vehicle.

Wherever possible, we’ll recover the cost from your insurer, or the third party insurer, so you’re not out of pocket. If it’s not possible to recover the cost from the insurer, you’ll be asked to pay for the recovery service.

What if my car is then off the road?

We’ll provide you with assistance in hiring a replacement vehicle should you require one whilst your vehicle is being assessed and/or repaired.

What if there’s no-one to recover the attendance cost back from?

We’ll always try to recover the cost of attendance from the party responsible for the road traffic accident, or your own insurer. If this is not possible, then you’llbe liable for the cost. We will however explore all options with you to help you get this money back and only ask you to pay as a last resort.
